Governor Gavin Newsom signs Assembly Bill 366

Assembly bill 366, signed by CA Governor Gavin Newson on Oct 13, 2025, extends CA’s ignition interlock device (IID) pilot program until January 1, 2033. The IID program, which was set to expire on January 1, 2026, requires repeat DUI offenders to install an IID in their vehicle. First-time DUI offenders may or may not be required to install an IID depending on the discretion of the court, with heightened consideration given to first-time offenders with .15% or more BAC. Prior versions of the bill aimed to close the first-time free pass loophole by requiring that all DUI offenders install IIDs and not just repeat offenders. The Senate Appropriations Committee, however, later revised the bill in response to DMV lobbying regarding funding challenges. In his signing message, Governor Newsom commits to working together next year with Assemblymember Cottie Petrie-Norris, the bill’s founder, “to develop a permanent framework that is effective, fiscally sustainable, and workable within the DMV’s operational realities.”
